Who’s in the wrong?

I got loaded today and the BOL stated 41825 lbs gross. When the loader came out to put the seal, i took a look at my load before closing the doors. From my previous experience, I determined I should be able to get legal on all axles. To make it on time for delivery, I parked outside on the street at the shipper and did my 10 hours. I would have to drive at night to make it on time. When i woke up, I stopped at a truck stop 10 miles away, fueled up, and got weighed at the cat scale at 11pm. I ended up being 1600 lbs over gross, so 81600 lbs. 34840 trailer axles, 34220 drives, and 12100 steers. Now the shipper is closed through the weekend and will open Monday. So Im stuck until i can get reworked monday. I let my boss know, and he was disappointed and so is the broker. They said I should have scaled right away. I own up to my mistakes, but in this situation where I had a tight schedule for delivery and the BOL stating the wrong weight, Im in a dilemma on whos fault it is.
