Curious about this because my naive ass fell into the trap (scam?) of “taking over the truck” at this company I’m working for. Afterwards I found out some shit about this truck that I didn’t know before. Like the guy who sold it to me potentially doesn’t even technically own it? The story I heard is that his ex-wife possesses the title and won’t release it to him because he owes her money, and the registered owner is the old LLC that they used to have together. I looked it up and that LLC is currently inactive and was dissolved 4 years ago. It’s also the company that is shown as the Lessor on the truck’s registration. It also turns out that this truck has had the DEF system deleted, which is not legal.
So I’m kinda putting the pieces together here and it seems like this guy sold me an illegal truck that he doesn’t even technically own, while it’s already under lease to this company, all under the name of an inactive LLC that was dissolved 4 years ago.
I’m not a legal expert but I’m pretty sure that even regardless of the extraneous circumstances and even if he does own this truck, you can’t lease a truck to two different people at the same time. Or you can’t lease a truck and sell it at the same time. Pretty sure that breaks some kind of business law but IDK. But the whole situation is a mess where potentially three different people have a legal claim to this truck — him, his ex-wife, and me.
So yes this was a stupid idea and I regret trusting this guy and I’m trying to get out of it, so roast me if you want. I just want to clean up this mess and not even be involved with these guys anymore. We’ve already talked about it and they said they can get me my money back but they’ve also said a ton of things that have never come true and I’m just trying to figure if I have any actual legal recourse instead of a verbal agreement.
