Okay so at my little corner of this company most of the dispatch team are also CDL holders and *some* of them OCCASIONALLY take a load (home daily).
We’re mileage paid drivers and while waiting around at the office one day I asked how pay worked for them, and they said they get the same detention pay we do ($20/hr). That’s less than we typically make running loads but they work 10-12hr shifts 5-6 days a week so I asked if the overtime balances it out…
They don’t get overtime. This sounds wrong to me. Some of them take like less than a load a month. I’m not sure if some of them ever do. Is my company misclassifying them as drivers when they should be normal non-exempt hourly employees? Is there a rule or threshold for this?
