International day cab loose brake pedal… violation?

We have a day cab rental through Ryder that is an International (not sure model) with the A26 engine. Anyway, it’s doing classic international stuff and the brake pedal is loose and flaps around while driving. It’s annoying as hell and it can’t be safe… I kinda need that brake pedal.
Anywho, I did my due diligence and sent a ticket to Ryder to come and fix it. The tech said it’s normal wear and tear and isn’t broken, so he won’t fix it. Fucker. Is this a DOT violation? I tried googling to no avail. I want to press the issue so it gets fixed. If it’s illegal I can sick the union on Ryder ????
