Back in 2020 had a failed pre-employment drug test. ( I don’t need to hear it) this is when they stated the process of putting you in the Clearinghouse and you have to do the RTD process. If you don’t know the Return to Duty Process it basically consists of you having to go to a drug and alcohol counselor that is approved FMCSA. They set up a plan for you. My plan is 4 years of random drug testing and a 12 hour online class. The schedule the drug testing is sent to my employer and they set up the Followup test for me.
Here is where the problem comes in. You have to do 4 years of testing if you don’t test because you don’t have an employer then your just sitting in limbo. Nobody will hire you once you are in the RTD process. It shows in your Clearinghouse that you are no longer prohibited and are able to operate a CMV. Once you complete your testing schedule then you are released from the RTD process from you employee and it shows in the Clearinghouse. I think there is confusion on how this actually works. There is not one company in the United States that I have found that will hire a driver once a dirty ua is in the Clearinghouse. I know this is very controversial and most will say oh well you made your bed. I think there is confusion in how this actually works. FMCSA put the program out to clean the industry up. But they may as well have said just suspend your CDL for said amount of time because it’s impossible to get a job therefore impossible to get the testing done to complete the process. This is a very taboo subject and many won’t talk about it or admit to it. But until we do nobody will no that the system they put in place is not working. Company’s have their own drug & alcohol policy and what FMCSA is doing does not coincide. Id like to know what others are experiencing.
