Broker didn’t pay, bond says it can pay 40%, how can I get rest of 60% or am I out of luck?

We hauled a load for a broker in September 2023 and they didn’t send payment and stopped answering email and phone call. In October, I call their insurance bond and file against their bond. They tried contacting freight spot but no reply so they started the process.

I just got email saying over 175k invoices from everyone who hauled for this broker and everyone will get paid % evenly at 40%ish. What can I do to get rest of 60%? Sue him at small claims court in his city?

So someone can open up brokerage, decide they’ll just scam everyone and not pay and not get in trouble by law?
